Does anyone know where the RBS employees who were fired stand as far non competes go. I know state laws very and in NC it seems that they are not going to keep you from working. Most of the time when we've been in a legal situation with it the court usually rules in a mixed favor of each. Dealer gets to keep the employee but the employee can't work in the same territory or have contact with their former customers.

any thoughts?

In Canada, you cannot enforce a non-compete. I would imagine it's similar in the US. The argument is that an employee's income is tied to skills and relationships that he or she gained while under employment. Whether you are a sales rep or a tech, you cannot take away an employee's ability to make money, even if it's in the same territory.

Most OEM's will enforce a 6-12 month non-compete clause. When we hire a new rep, our dealer principal is famous for calling the OEM legal department and saying, "I received your notice of non-compete and wanted to let you know I've already wiped my ass with it."

Non-compete clauses are a bluff. My wife works in veterinary medicine and they try to put the same garbage in her contract. When you tell them to take it out of the contract, they have to.
