a. Review of Bid Protest by Bircham’s (RFP#600-08-02-multifunction copiers):
Decision 09-10-1
The Pikes Peak Library District contracted with The Ascher Group to complete a Request for
Proposals (RFP) for copier services. The RFP was released on October 23, 2008. Four qualified
responses were received by November 10, 2008. District staff and The Ascher Group interviewed
all respondents, and The Ascher Group ranked the bidders’ proposals in three categories – cost, equipment, and service capability. Based on its review, The Ascher Group ranked All Copy
Products first overall (scoring it first out of the four bidders in both cost and equipment, and second of four in service capability). Lewan & Associates ranked second, Bircham’s Office Products (the District’s current vendor) third, and Ricoh Business Solutions fourth. Based on these rankings District staff recommended that the District select All Copy Products as its vendor to provide copier
services for the District for up to three one-year periods.

On February 24, 2009, the Board approved All Copy Products as the vendor for PPLD copier services. On June 1, 2009, Bircham’s
Office Products filed a formal bid protest. The bid protest was reviewed by The Ascher Group.
The Ascher Group reviewed each alleged ground for reversal individually, and re-calculated its
prior rankings, taking into account errors and irregularities alleged. The Ascher Group concluded that its original bid review had contained some minor errors in the pricing analysis, but these had included some that favored Bircham’s as well as some that did not, and none of the pricing errors affected the overall rankings of the bidders so as to change the outcome of the analysis.

After correction and re-calculation, The Ascher Group concluded that All Copy remains the highestranked bidder. Staff and outside counsel have reviewed.
