Hypothetically, if a company would let lots of people go, and then make the remainders sign new non compete, that limits them for 104 weeks from seeking any employment in the industry, whether they quit or get fired.......and, hypothetically, only gives them 5 days to sign or be fired.....is this the new norm in the industry.....

This came up in the CDA meeting this past week.

They appear to be pretty worthless other than protecting your accounts and the territory the rep worked in. We had a rep come and his noncompete said he couldn't work in the entire state for 18 months. Our lawyer told that dealer he would wipe his ass with the noncompete, flush it and we'd see them in court. We never heard anything else about it.

What does seem to hold up is tue rep cannot work in the same territory as before or have any contact with any dealer accounts.

Not worth the cost for legal fight it would take and the court will most likely side with a guy trying to make a living anyway.

The guy who would try to enforce one was probably an a-hole to work for from the beginning and has bigger problems with himself and his business than any problems that could be caused by competing in the marketplace with a former sales rep.
