You old employer will not be able to completely stop you from making a living in your field. In fact the more restrictive the non compete is the less likely a Judge will be inclined to honor it. Can you post the non compete agreement (just sanitize the names on it). I have heard of a Judge who allowed the ex employer to pick a very limited area (NOT New England, but maybe Boston proper) this leaves many other territories available for a Sales Rep to work. Here's my thinking and I should have elaborated a little more and should have been more detailed. 1000 pages per month @ .05 profit per page = $50, minus cost of giving away 500 @ .05 = $25, net profit (based on .10) is $25 per month, per machine. Yeah, I goofed! However, I also though of this. Attached you will find the SAP Printer Vendor Program document. You will see that Oce', KonicaMinolta, Sharp, and Kyocera are on it and Ricoh is not. They started off w/ 2 HP 4100's and 2 HP 9000's at the beginning of the term. Then, as they grew (expanded from 1 location to 11), they added hardware on a co-term basis. The problem is that the majority of their growth took place over the final 2 years of the agreement, and they still added hardware co-term. It ended up great for me, because i got all of the hardware at the same time, but it was a horrible decision on their part to lease that equipment for such a short period of time w/ out...

I don't see how they can make money at $.0045 per copy - does that include supplies. I have a customer with Savin 2055dp 2 years into a 5 year lease. Service is parts, labor, toner, developer, drum $.017 per copy Canon offered them a new machine at $.0077 per copy. Customer is about 2 hours from my office and only runs about 12k per month - what kind of pricing would you guys give on service and supply agreement for that kind of volume??

I would focus on the cost per page first. Find out of the customer is going to take a maintenance agreement. You may have win there. If no maintenance agreement is needed I would then focus on the consumables costs of the A4 device. Such as cost per page for toner, cost per page for drum (imaging) and cost per page for the fuser kit. I found the fuser maintenance kit on CDW for $269.99, however, there is no yield stated. 40% of my business last year came from Schools or Government. I found a few niche pain points that almost any District or Department would experience and used that as my lead in with the appropriate person. For example, for schools, it was Common Core State Standards. Learning the implications and compliance issues got me lots of appointments and 4 new Districts. Art, it's a part of the industry that I doubt you will get rid of. I would like to add my own "observation". I don't think that 99.9% of dealers do a good deal. If 99.9% was the case these instances would not even be noticed because they would be unheard of. I think the reality is that around 60-70% of dealers are OK. Grant: Thanx for the comment, here in the US there is the trade agreement also but it varies from dealer to dealer. If the customer opts to return the system then the dealer has the option to buy the equipment.

I'm not sure if that has an equivalent in the UK. here we have the Consumer Credit Act. However, it only applies to consumers. Business to business isn't covered (except in a small number of cases). The 3800 series and the smaller 224/324 share virtually the same fuser and its inability to run much more than 20 lb bond. We cover it in a maintenance agreement but running photo paper or any coated paper voids that and they pay for it.

At our company the rep gets a one time "bonus" for selling service agreements. More commonly viewed as being penalized for not selling service. However, I understand why. We don't truly believe you are our customer if you don't have a service agreement. Without service, you are more apt to be dissatisfied with your product and unless cycled regularly by your sales rep will become orphaned and be lost to the competition when you are ready to upgrade. While these systems do tend to have this problem it seems to me that if service is doing a good job then it shouldn't be of the magnitude that they are saying. I know that our service department does quarterly cleanings on all of our customers on a service agreement and they can address the problem then.

Let's not lose track of Jason's statement that most salesreps do not consult and customer's don't know who they are going to get from a dealership. We are all in agreement (including Jason) that the consultative approach is best but we are a minority in our business. Most reps do not, can not and will not do what it takes to be a specialist worthy of extra compensation.

It is true that Global dealers will still be able to get parts and supplies for 3 years, under a contractual agreement from Ricoh. However, Global will not get any firm ware upgrades or tech support. No Tech Hotline calls for when things need to get elevated. This is the bigger problem.

What came next with some dealers in the Oz market, was a guarantee that the client's copy costs would not rise annually, above a maximum of 10% which most clients would agree to. Or that it would only rise by the CPI, which these days is a joke of a deal, as it is only around 2%. Merlin, I ship stuff out all the time to RFG dealers by simply gaining agreement ahead of time on the rate of compensation for service, supplies, training, delivery etc. We then have the equipment drop shipped to the dealer for subsequent installation. The pricing level used to order the equipment shouldn't pose a problem. I will say that our compensation offer is better than the corporate rate. It also helps to have a feel for the cost of living etc. etc. for the area you're shipping to.
