You obviously deal with this much more than I but tell me this...Regardless of past emails and/or conversations, if the customer can prove that they own the equipment then they have proof that the leasing company leased an asset they didn't own. What more do you need?

No doubt it's fraud, that's an open and shut case. But I may never get to the bottom of why the individual in the organisation signed the agreement. I'll leave that to the imagination. It's a tough one as well, it was signed by the sister of the owner of the business!!

Art - As a general rule, when leasing to Muni/State Agency/Poly Subs, the customer can choose the lease structure that best fits their needs - Tax Exempt Muni Lease,standard $1.00 out, FMV lease agreement, Rental Agreement, etc. In New Jersey, tax exempt municipal leases and FMV are widely used. I disagree. Most law firms and many insurance companies still have a commonly re-ocurring need for mixed size originals. I am currently working with one European shipping company based in NA that wants to do do mixed size originals with a mix of A3 and A4 documents. I say it cannot be done as the paper is all of different widths. I am hoping that my unscrupoulous competitive vendors will admit to the same..... not likely!!! They want the sale today! Please advise.

A3 (11 x 17) and A4 (8 1/2 x 11) can be run at the same time with auto paper select making what you put in what you get out using mixed-originals and the mixed originals setting. The sizes you mention are European, but I'm sure they will work. As long as it's a standard document size it should work.

Sorry, I meant to say a mix of A4 and Legal size documents. I agree most copiers should be able to do mixed size originals with a combo of A3/A4 and Letter-R/Legal. The problem I am having and I do not think it can be done is one of a mix of A4 and legal mixing North American and European sized paper in the same document. This is because the two paper sizes are of different widths.

What are the best options to getting around an "evergreen" clause in a prospects lease contract? Specifically, if the clause renews the contract for 1 full year & they missed the timeframe to provide written notice to cancel? Is the prospect obligated to make every payment? Is there a way for me to win the business without having to refinance that full year of "evergreen" payments into the new lease? Your input would be appreciated. --Garrett

Hello Garrett - The dreaded "Evergreen" clause. This clause has caused many problems customer and dealers over the years. Depending on your situation, it may be tough for you to get the customer out of the contract early without some significant work on yours and the customers part. Art Some very good points here, for both a buyer and seller. So often a seller is focused on one aspect of the deal with others being and economic time bomb. I think offering the professional "bowing out" of a price deal is necessary to consider, as just when you think prices couldn't get lower, they do. Taking an approach towards a true, mutually beneficial deal will either get appreciated, or get your on your way towards finding one.

I suggest calling your local Ricoh Dealer (not direct), because dealers can offer better service, better support and they support your local economy. I am sure that varies with location.

Seriously? Which side are you on? Let's recognize that the dealer never pats for a lease return, it's just baked into the new lease. In this era of low margins, there is no room to offer these things for free. Additionally, there is no reputable dealer that would uplift 25% a year.

Cheryl Thanx for the response! I'm on the side of transparency. I want companies to recognize that there are some dealers that, well, they should not be doing business with. Here in the North East we're seeing some down right dirty tactics when it comes to moving product. I didn't understand Cheryl's response either. Another important question is the length of the automatic renewal. At least the "renews for like term" seem to have gone away but I still see some 12 month renewals. In my opinion, a customer should never agree to Automatic Renewal Terms of more than 3 months with the 30 day renewal being the obvious best choice. For me, it's more about the integrity of the leasing company or the dealer pushing that particular lease company. Nobody plans on going...

I had a similar situation with an existing account, the purchasing manager had to retire due to a medical issue. I reached out to the new purchasing manager, calls, emails, tried to get thru IT and no return call. Next thing I know they are cancelling the maintenance contracts on their equipment. I hate situations like this when you spend your time working a deal and then everything goes silent and you get the we went the stupid route call. Over and over again I've found that IT guys are total email monsters. You can call 10 times...nothing. Throw out an email and bang they are back online. If you can get their I try to get their attention with the subject line with a problem statement included like "Current (Ricoh, Xerox, Kyocera) Copier Lease Due With Issues Pending" for example...

I don't have any "data" but I will say that probably 80%-90% of the deals we are involved in are asking for a 36 month term. I will also say that where leasing used to be predominate, now leasing is required in less than half of the placements.

I don't have any real data without putting a bunch of time into it but I can tell you that we rarely do 36-month terms these days. Perhaps 15%. I've got one major account that does 39-month terms. The rest are 48 and 60. At one time I used to do a lot of 42-month leases because DLL had a rate special.

We are also 90% of 60 month terms; I don't even quote other terms unless the customer specifically asks for it. The percentage of leases vs. purchases is even higher I would say; 96% are leases. Very rare customers write a check for their equipment.

I used to always quote just 60, know I quote 36 standard and options for 48 and 60, just my way of whittling down the amounts of clients that take 60 month leases. I’d rather be back in at 30 months rather than 55 months

That brings up a good point. Of course it depends on your payplan but I would have great difficulty making my G.P. numbers if I didn't have renewal revenue from my 36 month leases. Anymore, there just isn't a good reason in my mind (in most cases) for someone to change equipment after just 3 years. I lower their payment 60% and still make good commission...they're happy, I'm happy, and my company's happy. I get a sale every 3 years instead of 5 with a much higher revenue and G.P. toward my...

Agree with @oldglory we shoulod push more shorter term leases, good for us and good for the client Especially for dealerships that have high escalation clauses in the maintenance/supply agreement. Lately manufacturers have not been refreshing the models like they did three years ago. On average it was every 24 months, now I'm seeing models hanging around 36 plus months.

I just got bit by Ricoh not refreshing models. Had a customer come to end of term on a particular model (MP C401sr) that has not refreshed now in over 4 years. It launched in May of 2014 and has never been refreshed. To me that's inexcusable. Because of the configuration I had nothing to offer the customer other than a brand new machine in the same model and configuration as the old machine or the option to take the Buyout to keep. I feel your pain!! I have C8003's out on three year leases that are due soon and there is no upgrade path there also. What worries me even more with Ricoh is the fact they are not manufacturing any of their A4 black devices anymore. I think this entire move to services is going to affect all of the refreshing, except for color MFP's and production.

They are made by Kyocera, Ricoh puts there tablet aka interface in replace of the Kyocera one

Are you sure? BLI says OEM is Ricoh. Drum lifes are pretty short for a Kyo product.

Take a look from the first try up on the Ricoh and compare to the Kyocera. Except for the interface they are identical. Both have the same print speed of 62ppm. In addition the Ricoh product guide does not reveal the drum life. The MP 501 and 601's were also the Kyocera print engines. There are small differences between each model. However you can see by the picture that these two devices are identical except for the interface of the Ricoh. I believe this was one of the trade-offs that Ricoh...

Not sure who makes the IM350/430 series. It may be Ricoh. Not a big fan of these products but I sell them because I have to. Wish Ricoh would bring back the MP201spf.

I noticed that the new PC600 color printer also looks to be a Kyocera product. Those funky shaped waste toner bottles were the give away. As for leases I always lead with 36 months, I agree with Art that I would much rather approach the customer at 30 months rather than 55. The only time I even show a 60 month is if I know the customer is shopping a competitor who pushes 60.
